    Class Action Lawsuit Filed Against Sony Interactive Entertainment for DualSense Drift Issue

    After the news about a US law firm studying the PlayStation 5 DualSense drift issue, it has now officially filed the class action lawsuit against Sony Interactive Entertainment.

    Law firm Chimicles Schwartz Kriner & Donaldson-Smith LLP (CSK&D) has formally filed the lawsuit against SIE, alleging them to have the DualSense controller defective due to the drift issue. It was noted that SIE was award of the issue but chose not to disclose it to the public. The law firm is calling the game company’s conduct, “fraudulent, deceptive, unlawful, and unfair.”

    According to media outlet IGN, the firm has filed the law suit in the US District Court for the Southern District of New York. It was filed in behalf of plaintiff Lmarc Turner and all of those who have the same situation. The defendants are Sony Corporation of America and SIE.

    Aside from the allegation of the drift issue, the lawsuit also alleges SIE giving only a few limited options for repairs. It is said that the website that is dedicated for handling the issues of the PS5 hardware is full of backlog and already redirecting the customers to a customer service agent via the contact page of the PS support page. The result is long wait times and a lot of pre-recorded machine responses before they are redirected to an actual agent. Many customers are now frustrated.

    The lawsuit is now asking for a jury trial. It is also asking for the following: “monetary relief for damages suffered, declaratory relief, and public injunctive relief.”

    This is a similar situation with the Joy Con controllers with the Nintendo Switch, which was also plagued with the drift issue. A lawsuit was also filed against game company Nintendo.
